Minarium Terms of Service

Effective Date: July 1, 2025

Welcome to Minarium! These Terms of Service ("Terms") govern your access to and use of the Minarium platform and services ("Services"). By using our Services, you agree to these Terms.

1. Overview

Minarium is a marketplace for buying, selling, and discovering 3D digital models, as well as participating in print bidding services and digital advertising. We offer tools for creators to list models, receive payments, and promote their products.

2. Accounts

To use Minarium, you must:

  • Be at least 18 years old (or the age of majority in your country).
  • Provide accurate, complete, and updated account information.
  • Keep your login credentials secure.
  • You are responsible for all activity under your account.

3. Creator Terms

If you upload or sell models:

  • You retain ownership of your original designs.
  • You grant Minarium a license to display, market, and distribute your models per your chosen terms.
  • You must have the rights to sell the models you upload.
  • You may not upload infringing, stolen, or pirated content.

Royalties & Commissions

Minarium charges commissions based on your creator tier (see Pricing Plan for details). You’ll receive payouts minus platform commissions and payment processing fees.

4. Buyer Terms

Buyers may:

  • Purchase models for personal use, under the terms set by the creator.
  • Request 3D print bids from verified printers.

Reselling or redistributing purchased models (digitally or physically) without explicit permission is prohibited.

5. Print Bidding Terms

Minarium enables buyers to request 3D print services:

  • Only verified, licensed printers may bid.
  • Bidding is private, with Minarium holding payment in escrow until delivery.
  • Creators receive royalties from each print job.
  • Printers must fulfill print orders promptly and accurately.

6. Digital Fingerprinting

All uploaded models may contain embedded digital fingerprints to:

  • Track piracy or unauthorized redistribution.
  • Verify ownership.

This process does not affect the usability or appearance of the model.

7. Advertising Terms

Minarium offers paid advertising opportunities:

  • Ads must be relevant to the 3D modeling and printing community.
  • Advertisers must follow our Ad Guidelines.
  • Fees for ads are outlined in the Ad Pricing page.

8. Payments & Fees

  • All payments are processed via third-party providers (Stripe, PayPal). Minarium does not store full payment details.
  • Creators and buyers are responsible for any applicable taxes.

9. Content Restrictions

You may not post or upload:

  • Infringing or counterfeit content.
  • Obscene, hateful, or abusive material.
  • Malware, spyware, or other harmful code.

We reserve the right to remove any content that violates these Terms or applicable laws.

10. Termination

We reserve the right to suspend or terminate your account if you:

  • Breach these Terms.
  • Violate intellectual property laws.
  • Engage in fraud or misuse of the platform.

11. Disclaimers

Minarium provides its Services on an "as is" and "as available" basis. We do not guarantee uninterrupted access or the accuracy of listings.

We are not responsible for:

  • Disputes between creators and buyers.
  • Losses due to unauthorized access to your account.
  • Print quality or delivery issues (though we assist in dispute resolution).

12. Limitation of Liability

To the maximum extent permitted by law, Minarium is not liable for:

  • Indirect, incidental, or consequential damages.
  • Lost profits or business opportunities.
  • Issues beyond our reasonable control.

13. Indemnity

You agree to indemnify and hold Minarium harmless from claims, damages, and expenses arising from your use of the Services or your violation of these Terms.

14. Governing Law & Dispute Resolution

These Terms are governed by the laws of Iowa, USA.

Any disputes will be resolved:

  1. First, through good-faith negotiations.
  2. If unresolved, via arbitration in Iowa, USA.

15. Changes to Terms

We may update these Terms from time to time. Changes will be posted on this page with the effective date.

Continued use of Minarium after updates means you accept the revised Terms.

16. Artificial Intelligence (AI) Use

Minarium uses AI-powered tools to improve search, discovery, and user experience on the platform. These tools may analyze metadata, previews, or user interactions to generate better recommendations and search results.

Importantly:

  • No Training on Creator Models: Minarium does not use the 3D models you upload to train our AI systems. Your designs remain your property and are not repurposed for AI training datasets.
  • Search & Discovery Only: Our AI systems are limited to indexing and matching models for search, discovery, and marketplace functionality.
  • Transparency: Any future changes to AI use that go beyond search and discovery will be disclosed in updated Terms before implementation.
